1. About These Terms

1.1. Definitions

“Services”

pertains to the offerings provided by Airsoft Connect accessible online (via Airsoft Connect websites) and offline (e.g. support).

“Platform”

refers to the online website of Airsoft Connect.

“Content”

encompasses any material such as data, text, design elements, picture, sounds, video, etc. made accessible by Airsoft Connect.

“User Content”

denotes any material contributed or posted by Users whilst utilising the Services.

“Organiser”

refers to event organisers or promoters utilising the Services to create and promote their events.

“Consumer”

refers to anyone utilising the Services to consume information, purchase tickets, attend Events, etc.

“Users”

“you”

refers to Organisers, Consumers and third parties utilizing the Services.

“Airsoft Connect”,

“we”,

“us”,

“our”

refers to Airsoft Connect website, employees, other representatives, etc.

“Terms”

refers to the terms and conditions outlined in this Agreement.

1.2. Other Applicable Terms

If an Organiser utilises our Services for events with paid tickets, Airsoft Connect's Merchant Agreement and Organiser Refund Policy Requirements also apply.

By accepting these Terms & Conditions, you also acknowledge that you have read the Privacy Policy and Cookie Statement. These documents are applicable to all Users.

Airsoft Connect may provide Services that are not defined under “Our Services”. Nonetheless, these Terms still hold sway over such services, unless a written agreement states otherwise.

These Terms constitute a legally binding agreement between you and Airsoft Connect, defining your rights and responsibilities when using our Services. If you are using our Services on behalf of another individual or business, you acknowledge that these Terms also pertain to that party.

1.2. Ongoing changes to these terms

Airsoft Connect reserves the right to modify these Terms. Material changes will be communicated to Users via the Services or through email.

Users are responsible for keeping up with posted changes. Continued use of the Services after changes automatically indicates acceptance of the updated Terms.

1.4. Scope of agreement

These Terms govern the use of Airsoft Connect Services and constitute the entire agreement between Users and Airsoft Connect.

In case of conflict between Airsoft Connect Terms and conditions and those of other parties, Airsoft Connect Terms and conditions prevail.

These Terms supersede any prior agreements or communications between a User and Airsoft Connect, with exception for specific written agreements.

2. Our Services

2.1. Scope of services

Airsoft Connect offered services include the following:

○ Displaying and listing events submitted by the Organiser;

○ Accepting and processing of online orders for event tickets;

○ Providing Consumers with a digital event ticket;

○ Assisting Consumers in finding relevant airsoft events;

○ Providing the platform for Organisers to create, manage, ticket and promote their events.

○ Providing Users with technical support;

○ Assisting Organisers in marketing their events to relevant Consumers.

2.2. Event ownership and responsibility

Airsoft Connect does not create, organise, or own any of the events listed on the Platform. Airsoft connect is not responsible for ensuring event quality.

The Organiser carries sole responsibility of ensuring that all products and services proffered in the event listing are delivered during the event. The Organiser also carries sole responsibility of ensuring the event is conducted abiding all applicable laws.

Airsoft Connect collects payments made by Consumers via third-party payment service providers and transfers such payments to the Organiser (as defined in the Merchant Agreement).

2.3. Order Processing

The Consumer places an order through the Platform. The Organiser then can either confirm or deny participation in the event. If the Participant is confirmed, payment information is sent to the provided Participant email address. After the payment is complete and marked as “Paid”, the Participant immediately receives a digital event ticket.

2.4. Ticket Delivery

Event tickets purchased through Airsoft Connect are distributed electronically, via email provided by the Consumer during checkout.

Purchase receipt will be sent to Consumer provided email immediately after purchase. In case of issues or delays Consumers are encouraged to contact Airsoft Connect support.

3. Consumer Privacy

3.1. Privacy Policy

Information provided to Airsoft Connect by Users or collected by Airsoft Connect is governed by our Privacy Policy.

No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, Airsoft Connect cannot guarantee or warrant the security of any information you transmit to Airsoft Connect, and you do so at your own risk. Airsoft Connect does not guarantee the security of the portal or the services or the prevention from loss of, alteration of, or improper access to, your account information or data.

3.2. Organiser Responsibility

Organisers agree to comply with all applicable laws regarding the collection and use of consumer information, as well as any related policies posted on the Services.

4. Release and Indemnity

Users agree to indemnify Airsoft Connect against any legal or other claims or expenses resulting from their use of the Services.

4.1. Release

Users agree to release Airsoft Connect from any damages and losses arising from disputes with other Users and third parties, related to listed events or the Services themselves.

4.2. Indemnity

Users agree to reimburse and protect Airsoft Connect and its representatives from any damages or losses resulting from User's breach of these Terms, misuse or abuse of Services, violation of applicable laws, and claims from third parties.

5. User responsibility

5.1. User accounts

To access specific features and functionalities, Airsoft Connect requires Users to create an account.

Users must adhere to certain rules when creating and operating their account, including:

○ Abiding by all relevant laws during account creation;

○ Providing accurate information about themselves or the entity they represent. Users must also update this information if it changes;

○ In case of a dispute over account ownership Airsoft Connect will serve as the sole arbiter. Our decision will be conclusive and may include suspending or terminating the disputed account;

○ Users who are using the Services on behalf of a company or another entity are expected to have the authority to legally bind that entity;

○ Users must report any unauthorised use of their account and any possible security breaches to Airsoft Connect. Users are accountable for any activity occurring under their account.

6. Consumer responsibility

When purchasing event ticket, User is responsible for meeting requirements and restrictions set by the Organiser, including but not limited to age censorship. Airsoft Connect holds no liability if disobeying set guidelines results in financial loses and elimination from event to the User.

User is responsible for abiding the law and Organiser set rules during events. User holds liability for their actions and releases Airsoft Connect from liabilities resulting from User's misconduct.

7. Organiser responsibility

7.1. Licences and permits

Organisers are responsible for ensuring compliance with applicable laws, obtaining needed licences, permits or authorizations for their events. Airsoft Connect is not liable for any losses or damages resulting from issues with licences or permits, and non-compliance with the law.

7.2. Event requirements

Organisers are responsible for setting the rules and requirements for their events. It is their responsibility to ensre that the set rules are aligned with all applicable laws.

Airsoft Connect cannot guarantee all Users to meet Organiser set requirements and restrictions. When conducting an event, Organiser is responsible for ensuring participants match the set restrictions. Organiser releases Airsoft Connect from liabilities resulting from User failure to meet requirements.

8. Disclaimer of Warranty & User Risk

Airsoft Connect aims to deliver the Services as expected by Users. However, certain aspects cannot be guaranteed.

Airsoft Connect explicitly disclaims all warranties. Airsoft Connect does not guarantee that the Services will meet Users' requirements or be error-free.

Users acknowledge that Airsoft Connect cannot ensure the quality, accuracy, safety, or legality of any event or Content provided by Users.

Airsoft Connect is not liable for any actions or omissions by third parties that Airsoft Connect engages to provide the Services.

Consumers understand that certain events carry inherent risks, and participation in events implies voluntary acceptance of those risks.

These disclaimers apply to the fullest extent permitted by law.

9. Limitation of Liability

9.1. Limitation of Liability

Airsoft Connect will not be liable to Users or third parties for any damages to the extent permitted by applicable laws.

9.2. Exceptions

Any warranty or right that cannot be excluded or limited by law remains unaffected by these Terms. Only lawful liability limitations in your jurisdiction will apply.

10. Services Licence

10.1. Licence to Services

Airsoft Connect grants Users a limited, non-exclusive, non-transferable, revocable right to use our Services as Consumers (to discover and attend events) or Organisers (to create events and sell tickets).

Users must use the Services in compliance to these Terms and applicable laws.

10.2. Restrictions

Users agree not to copy or derive from the Services, reverse engineer any part of the Services, or use the Services for unauthorised commercial purposes. Users also agree not to remove or alter any proprietary notices on the Services or disrupt the Services.

10.3. Copyrights & Intellectual Property

Users agree that all Site Content may be protected by copyrights or other intellectual property laws. Airsoft Connect may own or have access to Site Content through arrangements with third parties.

Site Content available through the Services is Airsoft Connect's exclusive property and is protected by copyright laws. Users agree to use the Site Content only as permitted by these Terms and applicable laws.

10.4. Trademarks

Airsoft Connect's trademarks used in connection with the Services are registered and unregistered trademarks of Airsoft Connect. Other company, product, and service names may be trademarks owned by third parties.

Users may not use any trademark without Airsoft Connect's prior written consent.

All goodwill from the use of Airsoft Connect Trademarks will benefit Airsoft Connect. Patents and copyrights apply to the Services.

10.6. Ban on Commercial Use

Site Content is not for commercial use by Users. Users agree not to use Site Content for commercial purposes or extract data from the Sites.

11. Fees & Refunds

11.1. Airsoft Connect Fees

Creating an account or listing events is free. However, fees apply to ticket sales. Fees include a flat event fee plus a set amount per ticket sold. Organisers may pass fees to Consumers or absorb them into ticket prices.

Airsoft Connect are not responsible for bank or credit card fees. All Users should check with their bank for applicable fees.

11.2. Ticket Transfer

Users can transfer tickets by following instructions on the site.

11.3. Refunds

Ticket transactions are between Organisers and Consumers. To request a refund, Consumers should go to the tickets section of their profile, select “Request a refund” on preferred event, enter any requested details and wait for an organiser to contact them.

Airsoft Connect's Fees are deducted from refunds regardless of ticket price inclusion.

Terms for refund claims are set by the organiser. Refunds must comply with Organisers' policies. Consumers are responsible for reviewing event details before purchasing tickets.

In case there is a delay or issue with a refund request, Consumers can contact support@airsoftconnect.co.uk.

12. User Content

Airsoft Connect does not regulate nor hold responsibility for user-submitted Content. By using the Platform, Users may encounter Content that is offensive, inaccurate, or otherwise objectionable.

Airsoft Connect doesn't guarantee the accuracy, completeness, or authenticity of Content posted on the Site. Users bear all risks associated with using and/or relying on any Content. Airsoft Connect is not liable for any loss or damage incurred due to the use of any Content on the Site.

Prohibited Content includes, but is not limited to, material promoting racism, harassment, spamming, false information, illegal activities, pornographic material, or solicitation of personal information. Airsoft Connect does not pre screen or approve Content before it is posted. Users are solely responsible for the Content they publish or display. Airsoft Connect may review and delete any Content that violates these Terms, or might be offensive, illegal, or threatening. Airsoft Connect reserves the right to investigate and take legal action against anyone violating this provision.

By posting Content on the Site, Users grant Airsoft Connect a licence to use, copy, perform, display, and distribute that information.

Airsoft Connect may preserve User Content and disclose it if required by law or to protect the rights and safety of Airsoft Connect, its Users, and its representatives.

13. Notices

Airsoft Connect may send notices to Users via emails registered in Airsoft Connect's records or by displaying notices on the Platform.

14. Termination of Agreement

14.1. Terms Duration

These Terms remain effective until agreement is terminated. Upon termination of this agreement, Terms will generally no longer apply. However, certain provisions will always remain applicable to both Users and Airsoft Connect.

14.2. Termination by Airsoft Connect

Airsoft Connect reserves the right to terminate a User's access to the Services, in cases of Terms violation, misuse or abuse of provided Services, and in case of legal liability, to the extent permitted by applicable laws.

Airsoft Connect has the right to partially or fully discontinue offering Services. In such case, Users will receive notice in advance. Airsoft Connect will hold no liability to Users and third parties for termination of Services.

14.3. Termination by Users

User has the right to terminate applicability of these Terms and access to the Services by deleting their account.

Users without an account are able to terminate this agreement by not using the Services. As long as Users use and have access to the Services, these Terms remain in effect.

14.4. Exceptions

Any provisions that naturally persist beyond the termination of these Terms will continue to be effective.

15. Applicable Law and Jurisdiction

This Agreement shall be governed by the applicable law of the country where the Airsoft Connect entity is registered. Parties submit to the exclusive jurisdiction of the Courts in those countries for any claim.

16. Force Majeure

Airsoft Connect won't be held accountable for any delay or failure in providing the Services due to circumstances commonly referred to as "force majeure." These include war, riots, embargoes, terrorism, strikes, accidents, or any other causes beyond Airsoft Connect's control, that prevent or hinder its obligations under these Terms.

17. Other Provisions

If Airsoft Connect doesn't enforce any part of these Terms, it doesn't mean that it waives its right to enforce them later on.

Even if any part of these Terms is found to be unenforceable, the rest of these Terms will still remain in full force and effect.

The section titles and numbering in these Terms don't have any legal significance. Airsoft Connect can freely assign any of its rights and obligations under these Terms. These Terms may be translated into other languages. If there's a conflict between the English version and a translated version, the English version will prevail.
